These terms explain what Motor Match provides when you list your car, what you are responsible for, and how fees work. You remain the seller and make every decision about your car.
1.About these terms
These seller terms apply between you and [Motor Match legal entity name, company number and NZBN] (Motor Match) when you apply to list, and list, a car on Motor Match. They sit alongside the website terms of use and the privacy policy.
You accept the version of these terms shown to you before you pay the listing fee. We keep a record of the version you accepted.
2.Our role and yours
Motor Match provides a platform and services that help you present your car and complete a private sale. You remain the seller.
- You set your asking price, approve your listing and decide whether to accept, decline or reply to any offer.
- Any sale agreement is made directly between you and the buyer. Motor Match is not a party to it.
- Motor Match is not your agent and does not act for you in the sale. We do not negotiate, and we never make, change or accept an offer on your behalf.
- Our team may pass on a message, or prepare a document from your written instruction for you to review and approve. The words and decisions remain yours.
- Your car stays in your possession until handover to the buyer. Motor Match does not take possession of it.
3.Who can list, and your authority
By applying you confirm that:
- you own the car, or are authorised in writing by its owner to list and sell it;
- you have told us about any money owing on the car (for example a loan secured over it) and the lender's name;
- the information you give us about the car and yourself is true and complete to the best of your knowledge; and
- you have told us accurately whether you are selling in trade.
We may ask for evidence of identity, ownership or authority, and may decline an application at our discretion. Approval means your application met our listing criteria. It is not a check or confirmation of the car's condition, history or title.
4.If you sell in trade
If you are a motor vehicle trader, or are selling in trade for any other reason, you must tell us when you apply and make this clear to buyers.
You keep all of your own obligations as a seller in trade, including under the Motor Vehicle Sales Act 2003, the Consumer Information Standards (Used Motor Vehicles) Regulations 2008 (including displaying a Consumer Information Notice), the Fair Trading Act 1986 and the Consumer Guarantees Act 1993. You must comply with them. Listing on Motor Match does not change or transfer any of those obligations.
5.What we provide
For an approved listing, and as described on the fees page when you accept these terms, we provide:
- a professional photo shoot at an agreed location by a photographer we arrange;
- a listing description prepared from the facts you supply, for your review and approval;
- publication of your approved listing on Motor Match and the other channels shown in your portal;
- an owner listing pack so you can list on other sites, such as Trade Me, from your own accounts;
- a dedicated enquiry phone number and email address for your car, and your seller portal;
- enquiry support, identity-checked viewing bookings, offer and agreement documents, and a shared completion timeline; and
- introductions, at a buyer's request, to independent partners for finance, trade-in, shipping and other services.
We do not promise that your car will sell, the price it will sell for, or how long it will take. We will tell you if any channel is unavailable or fails.
6.Your listing content
You must tell us about all faults, damage, modifications and other matters a reasonable buyer would want to know, and correct anything that changes. Descriptions we prepare keep every fault you disclose.
Nothing is published until you approve the complete listing: photographs, description, specifications and price. Material changes later need your approval again.
You must give the photographer reasonable access to the car at the agreed time. The photographer contacts you directly to arrange it, and uses your contact details only for that booking.
You allow Motor Match to use the photographs and description to present and publish your listing while it is active, and to show the car as sold for [period and purposes for using listing content after sale: for the lawyer to finalise].
7.Fees
Our fees are platform and service fees for using Motor Match and the services described above.
- Listing fee. Payable after your application is approved and before the photo shoot is booked. The amount is shown on the fees page and before you pay.
- Platform success fee. [Success fee model: whether it is fixed or a percentage of the agreed sale price, the rate or amount, any minimum, exactly what event makes it payable, and how a sale to a buyer introduced through Motor Match but completed elsewhere is treated: business decision for Motor Match, wording for the lawyer to finalise.]
- Listing fee credit. The listing fee you paid is credited against the platform success fee.
- When and how paid. [Whether the platform success fee is charged separately by card or deducted on release under the escrow provider's process: to be confirmed with iPromise and the lawyer.] Motor Match fees are always kept separate from the purchase money.
- GST. Fees include GST where it applies. You receive a receipt for every payment.
Before you accept an offer, your portal shows the platform success fee and your expected proceeds. Charges by partners, escrow fees and other sites' fees are shown separately and are not Motor Match fees.
8.Listing period
[Listing period, any exclusivity period, renewal, notice to end the listing, and what applies if the car is sold elsewhere during the listing: business decision for Motor Match, wording for the lawyer to finalise.]
You can withdraw your listing at any time through your portal or by contacting us. Withdrawing does not cancel an agreement you have already signed with a buyer.
9.Enquiries and viewings
Enquiries made through your car's Motor Match phone number, email address or listing are recorded in your portal. Calls may ring our team first and forward to you as set out in your portal. [Enquiry handling arrangements, including hours, call forwarding and any obligation to bring enquiries from other channels into Motor Match: for the lawyer to finalise.]
If you list on Trade Me or another site, you do so from your own account and under that site's rules and fees. We will never ask for your password or operate your account.
Viewings are booked into the times you make available. A buyer completes an identity check before a viewing at your home is confirmed. You decide whether to offer test drives and on what conditions, including your own insurance and supervision. An identity check confirms identity only; please use your own judgement.
10.Offers and the sale agreement
Buyers make offers through the platform. You can accept, decline or reply with your own terms. Every version must be approved by the party it belongs to. Silence or opening a message never counts as acceptance.
When terms are agreed, the platform produces a sale agreement from a template approved by Motor Match's lawyer, for both parties to sign electronically. [The point at which the sale agreement becomes binding, and the standard terms of the agreement template: for the lawyer to finalise.]
As the seller you are responsible for your obligations under the sale agreement, including delivering the car as described, clearing any security interest, and completing your NZTA change of ownership notification.
11.Escrow and payment of the purchase price
The purchase price is paid by the buyer to iPromise, an independent escrow provider, and released under the agreed terms. Motor Match never receives, holds or releases purchase money.
You must complete iPromise's identity verification before funds can be released to you. iPromise's own terms apply to its service. Release follows the completed handover checklist and the required confirmations, and is never triggered only by time passing.
Where money is owing to a lender, the payout to the lender is arranged as part of the agreed settlement before any balance is paid to you. [Deposit rules, escrow fee responsibility and lender payout mechanics: to be confirmed with iPromise and the lawyer.]
12.Cancellation and refunds
[Cancellation and refund rules for the listing fee, including before and after the photo shoot, if an application is declined after payment, and if Motor Match cannot provide a service: for the lawyer to finalise.]
If we cannot provide a service you have paid for, we will tell you promptly and offer an appropriate remedy.
13.Our obligations and your rights
We will provide our services with reasonable care and skill and within a reasonable time. Where you acquire our services as a consumer, the Consumer Guarantees Act 1993 applies, and nothing in these terms limits your rights under it, the Fair Trading Act 1986 or any other law that cannot be limited.
Motor Match is responsible for its own conduct and for the content it prepares.
14.Privacy
We handle your personal information as set out in the privacy policy. Buyers never see your home address publicly; the viewing location is shared only with a confirmed, identity-checked buyer.
15.Changes, complaints and law
We may update these terms for future listings. Changes do not affect a listing period or agreement already under way unless you agree.
Our complaints process explains how to raise a concern. These terms are governed by New Zealand law.
