Plain-language terms for using Motor Match. Please read them alongside the seller terms or buyer terms that apply to you.
1.About these terms
These terms apply when you visit or use the Motor Match website, app and portals (together, the platform). The platform is operated by [Motor Match legal entity name, company number and NZBN] (Motor Match, we, us).
If you list a car, the seller terms also apply. If you enquire about, view, offer on or buy a car, the buyer terms also apply. Our privacy policy explains how we handle personal information.
By using the platform you agree to these terms. If you do not agree, please do not use the platform.
2.What Motor Match is
Motor Match is an online facility where owners list their own cars for private sale and buyers find, enquire about and buy them. We provide the platform and related services such as listing presentation, enquiry tools, viewing bookings, offer and agreement documents, and introductions to independent partners.
- Every car on the platform is sold by its owner. Motor Match does not own, buy, sell or take possession of the cars listed.
- Any agreement to buy a car is made directly between the buyer and the seller. Motor Match is not a party to that agreement.
- Motor Match is not the seller's agent and is not the buyer's agent. We do not negotiate for either party. Offers are always made, changed and accepted by the parties themselves.
- Motor Match never receives, holds or releases the purchase price. Purchase money is paid to iPromise, an independent escrow provider.
Motor Match is responsible for its own conduct, its own services and the content it prepares, as the law requires.
3.Your account
You must be at least 18 years old to create an account. You agree to give accurate information and keep it up to date.
We sign you in with secure links sent to your email, and for some steps with a one-time code sent to your verified phone. Keep access to your email and phone secure, and tell us promptly if you think someone else has used your account.
Accounts are personal. Do not let anyone else use your account or act in your name.
4.Listings and content
Listing information comes from the owner. We may prepare photographs and a description from the facts the owner gives us, and the owner approves the final listing before it is published. We take reasonable care with the content we prepare.
Checks shown on a listing, such as a registration lookup, are shown with their source and date. They are not a full history, finance, mechanical or title check unless the listing clearly says otherwise.
If you think a listing is inaccurate or unsafe, please tell us.
5.Acceptable use
When using the platform you must not:
- give false or misleading information, or impersonate anyone;
- list a car you are not entitled to sell, or use the platform for any unlawful purpose;
- ask anyone to pay the purchase price outside the escrow process shown in the portal;
- harass, threaten or discriminate against anyone, including at a viewing;
- copy, scrape or misuse the platform, its content or other users' personal information;
- interfere with the security or operation of the platform.
6.Fees and payments
Motor Match charges platform and service fees to sellers, as shown on the fees page and in the seller terms. These fees are paid to Motor Match through our payment provider.
The purchase price of a car is paid by the buyer to iPromise and released under the agreed terms. It is never paid to Motor Match. If anyone asks you to pay the purchase price any other way, do not pay and contact us.
7.Partner services
Finance, trade-in, shipping, inspection, insurance, warranty, identity verification and escrow services are provided by independent businesses under their own terms. With your consent, we introduce you, share the information needed for the service and show you its status.
Motor Match does not give financial, insurance, legal or mechanical advice. Some partners may pay Motor Match a fee for an introduction; where that happens we disclose it as required.
8.Your rights under consumer law
Nothing in these terms, or anywhere on the platform, limits or excludes any right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that cannot be limited or excluded.
Where you receive services from Motor Match as a consumer, those services come with guarantees under the Consumer Guarantees Act 1993, including that they will be carried out with reasonable care and skill.
[Any provisions for customers acquiring services for business purposes, to the extent the law permits: for the lawyer to finalise.]
9.Our responsibility to you
We will provide the platform and our services with reasonable care and skill. If we fall short, you have the remedies the law gives you.
We work to keep the platform available and secure, but it may sometimes be unavailable for maintenance or for reasons outside our control.
[Any limitation of Motor Match's liability for its own services, to the extent the law allows and without limiting consumer rights: for the lawyer to finalise.]
10.Intellectual property
The platform, its design and the Motor Match brand belong to Motor Match or its licensors. Photographs and descriptions prepared for a listing may be used as set out in the seller terms.
You may use the platform for its intended purpose. You must not reproduce or reuse its content for other purposes without our permission.
11.Suspending or closing accounts
We may suspend or close an account, or remove a listing, if we reasonably believe these terms have been breached, someone is at risk, or the law requires it. Where appropriate we will tell you why and give you a chance to respond.
You can close your account at any time by contacting us. Records we must keep, such as signed agreements, are kept as set out in the privacy policy.
12.Changes to these terms
We may update these terms from time to time. We will show the version and date at the top of this page and tell account holders about material changes before they take effect. Changes do not affect an agreement or transaction already under way.
13.Complaints and disputes
If you are unhappy with our service, please follow our complaints process. It also explains the external options available to you.
14.Governing law
These terms are governed by New Zealand law, and the New Zealand courts and tribunals have jurisdiction.
